Right of Withdrawal, Returns and Warranty for the Online Shop
Scope
This page governs the right of withdrawal, returns and the legal guarantee for products purchased through the online shop at fair.it.
Pages dedicated to F.A.I.R.® shotguns normally serve informational and catalogue purposes. For a firearm purchased from a distributor or gun shop, the customer must first contact the seller from whom the purchase was made, without prejudice to the possibility of requesting technical assistance from the manufacturer.
For orders placed through the online shop, the party responsible for withdrawal and the legal guarantee is the seller identified during checkout, in the order confirmation and in the tax document.
Withdrawal for change of mind
The Consumer, meaning the natural person who purchases for purposes unrelated to their business, commercial, craft or professional activity, has 14 days to withdraw from the distance contract without giving any reason, subject to the exceptions provided by law.
For a single item, the period begins on the day on which the Consumer, or a third party other than the carrier and designated by the Consumer, takes physical possession of the product.
For several goods ordered in a single order and delivered separately, the period begins upon delivery of the last item. For goods consisting of multiple lots or pieces, it begins upon delivery of the last lot or piece.

Withdraw from the contract here
The function allows the Consumer to identify the order, provide or confirm the necessary information, select the products concerned, view the summary and submit the withdrawal declaration.
After submission, the system sends a confirmation on a durable medium without undue delay, normally by email, containing the submitted declaration, the relevant identification code and the date and time of submission.
To meet the deadline, it is sufficient for the declaration to be submitted before the 14-day period expires.
Use of the online function is recommended but not mandatory. The Consumer may also exercise the right by sending an explicit declaration to info@fair-store.com or to the Seller’s other contact details stated in the order confirmation.
No specific wording is required, provided that the communication clearly expresses the decision to withdraw and allows the order to be identified.
Exercising the right is not subject to prior authorisation or approval. After receiving the declaration, the Seller may communicate the operational instructions and the address to be used for the return.
Optional form and label
The PDF form and label available below are optional tools. They do not constitute conditions for the validity of the withdrawal, prior return authorisations or prepaid shipping labels, unless expressly stated otherwise.
Returning products
The Consumer must return or hand over the goods without undue delay and in any event within 14 days from the day on which they communicated their decision to withdraw. The deadline is met if the goods are sent before it expires.
Where withdrawal is exercised because the Consumer has simply changed their mind, the direct costs of returning the goods are borne by the Consumer, unless otherwise agreed or unless the required prior information was not provided in the cases laid down by law.
Tracked shipping and packaging suitable for the product’s weight, dimensions and nature are recommended.
For safety reasons, products must be shipped without any foreign object, ammunition or prohibited material. The Buyer must comply with any restrictions applicable to the transport of regulated accessories or components.
The return must not be sent directly to the manufacturer’s premises unless that address has been expressly stated in the instructions relating to the specific order.
Condition of the returned product and reduction in value
The Consumer may inspect and handle the product to the extent necessary to establish its nature, characteristics, compatibility and functioning, in a manner comparable to what would normally be allowed in a store.
The product must be returned with any accessories, components, manuals, documents and equipment received.
Where still available, the original boxes, labels, bags, seals, protective materials and packaging must be used or placed inside suitable outer packaging to reduce the risk of damage. The absence of the original packaging does not automatically result in the loss of the right of withdrawal.
The Consumer is liable only for any actual reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, compatibility and functioning.
If a reduction in value attributable to such handling is found, the Seller may reduce the refund proportionally to the actual loss established, providing the reasons and the elements used to determine it.
No fixed penalties of 60%, 80% or any other predetermined percentage apply. The product is not automatically sent back to the Consumer solely because the original packaging is missing or because it cannot immediately be resold as new.
Refunds in the event of withdrawal
In the event of a valid withdrawal, the Seller refunds the amounts due without undue delay and in any event within 14 days from the day on which it was informed of the Consumer’s decision.
Unless the Seller has offered to collect the goods directly, it may withhold the refund until the products are received or until the Consumer provides evidence that they have sent them back, whichever occurs first.
The refund is made using the same means of payment used for the purchase, unless otherwise expressly agreed, and does not result in any costs for the Consumer.
In the event of withdrawal from the entire order, the refund includes the price of the products and the initial standard delivery costs, where due.
Supplementary costs resulting from the choice of a delivery method other than the least expensive standard method offered by the Seller are not refunded.
In the event of withdrawal concerning only some products, the price of the returned goods is refunded. Initial delivery costs are refunded only where and to the extent provided by applicable law; no automatic proportional refund is due where the delivery cost would have remained unchanged even without the returned products.
No retroactive shipping charge is automatically applied solely because, after a partial withdrawal, the value of the products retained falls below any free-shipping threshold.
Exclusions from the right of withdrawal
The right of withdrawal is excluded in the cases provided for by Article 59 of the Italian Consumer Code, where the relevant requirements are actually met.
In particular, it may be excluded for non-prefabricated goods produced on the basis of an individual choice or decision by the Consumer or clearly personalised goods, such as components made or adapted according to specific measurements, finishes or work that make them not normally resalable.
The mere production or acquisition of the product after the order, the choice among standard variants or temporary lack of stock are not, by themselves, sufficient to exclude withdrawal.
Any exclusion must be clearly stated before purchase on the product page, in the quotation, shopping cart or order summary.
Where an order includes products subject to withdrawal and excluded personalised products, withdrawal remains available only for the products that qualify.
The exclusion of withdrawal does not limit the legal guarantee for defective, damaged or incompatible products in relation to the confirmed information, or products otherwise not in conformity with the contract.
Commercial replacements
A replacement requested solely for commercial reasons, such as changing a correctly ordered and delivered model, size, colour or variant, is not the same as the right of withdrawal or the legal guarantee.
The replacement may be accepted by the Seller in accordance with the commercial conditions communicated to the customer. The relevant return and new-shipment costs may be charged to the Buyer.
The availability of an alternative product is not guaranteed until confirmed by the Seller.
Defective, damaged or non-conforming products
Requests concerning defective, damaged or non-conforming products are separate from withdrawal for change of mind and are handled under the legal guarantee.
The product is conforming when it corresponds to the description, model, quantity, quality, measurement, variant, declared compatibility and other characteristics provided by the contract; is suitable for ordinary use and for any particular use accepted by the Seller; and is supplied with the promised accessories, documentation and instructions.
Examples of possible conformity defects include:
- a product different from the one ordered;
- a component incompatible with the model or code expressly confirmed by the Seller;
- defects in materials, workmanship, finish or functioning;
- missing included components or accessories;
- damage occurring during transport;
- missing or inadequate instructions where necessary for correct use or installation.
The Buyer’s selection of an incompatible spare part despite correct and clearly available information before the order does not, by itself, constitute a defect.
Damage caused exclusively by incorrect installation, improper adaptations, unauthorised modifications, use on incompatible models, misuse or failure to follow the instructions does not constitute an original defect. Product defects and incorrect information or instructions attributable to the Seller or Manufacturer remain covered.
Work by an unauthorised person does not automatically eliminate every warranty: only problems causally attributable to the incorrect work may be excluded.
How to report a defect
The Consumer may report a defective, damaged or non-conforming product by writing to info@fair-store.com or to the different contact address stated in the order confirmation.
To facilitate handling, it is useful to state:
- the order number;
- the product and relevant code;
- the model, gauge, version or serial number relevant to compatibility;
- a description of the problem;
- photographs or videos of the product, packaging and any damage.
Photographs, videos or other evidence may be requested only where reasonably useful and must not become an obstacle to exercising the guarantee.
Use should be stopped immediately where the problem may affect the safety of the product or of the firearm on which the component is installed.
The problem should be reported without delay. No two-month forfeiture period from discovery of the defect applies to the Consumer.
The return is not subject to a discretionary assessment of acceptance or refusal. The Seller may inspect the defect and communicate the operational method required to apply the remedies provided by law.
Remedies under the legal guarantee
Where the Buyer is a Consumer, the Seller is liable for any lack of conformity existing at the time of delivery and becoming apparent within two years.
The action seeking the remedies provided for defects not fraudulently concealed is time-barred twenty-six months after delivery.
Unless proved otherwise, a defect becoming apparent within one year of delivery is presumed to have existed at delivery, unless that presumption is incompatible with the nature of the goods or the defect.
In the event of a lack of conformity, the Consumer is first entitled to restoration through repair or replacement, free of charge, within a reasonable period and without significant inconvenience, unless the chosen remedy is impossible or involves disproportionate costs compared with the alternative.
Where the conditions laid down by law are met, the Consumer may obtain a proportionate price reduction or termination of the contract.
Termination is not permitted where the defect is minor. The burden of proving that the defect is minor lies with the Seller.
Where the product must be made available for inspection, repair or replacement, the necessary transport costs are borne by the Seller.
The original packaging may be recommended but is not an automatic condition of the guarantee.
In specific cases, the Seller may decide not to require the return of the defective product. This choice is an operational method and does not limit the remedies recognised by law.
Commercial warranty and manufacturer assistance
Any commercial warranty offered by F.A.I.R.® S.r.l. is additional to the legal guarantee and does not replace or limit it.
For problems relating to a F.A.I.R.® shotgun purchased from a distributor or gun shop, the customer must contact the seller from whom the purchase was made. The customer may also request technical assistance from the manufacturer through the contact details published on the Website.
Repairs, adaptations and work on essential parts of the firearm must be carried out by the manufacturer or by a gunsmith, repairer or qualified technician. The warranty may exclude damage caused by improper work, but not original defects without a causal link to such work.
Transport costs for returns
The following table is retained in the operational format already published. For the statutory withdrawal period, the 14-day period stated in this page applies.
